Almira, Rednes Black. Court to Force Trial Transcript pt By AL DIEFFENBACH An order from the State Supreme Court soon is expected to set the wheels in motion for another appeal by two convicted robbers who recently won a 5-4 decision in the U.S. Supreme Court. The U.S. court's verdict would allow Robert Draper and Raymond Lorentzen a complete, free transcript of their trial in Superior Court here in 1960.

Both were sentenced to two consecutive 20-year terms and have been in the State Penitentiary pending appeals. Planning an appeal to the State Supreme Court, Draper and Lorentzen asked for transcript in order to try to prove that the verdict was wrong for 12 reasons. Spokane County Superior Court Judge Hugh H. Evans ruled that the evidence in the case was overwhelming and that the request for a transcript was frivolous. The State Supreme Court upheld Judge Evans, who was acting under the rules of the state court.

His decision to deny the transcript was backed by the state court on the ground that written statement of the trial was available and had been drawn up with the concurrence of the attorney for Draper and Lorentzen. The U.S. Supreme Court ruled that to withhold a full transcript of the trial from the two defendants denied from their constitutional right as indigents unable to afford the cost of a transcript. $400 for Transcript Don Sturdevant, Superior Court reporter, said the full transcript probably would cost about $400 at the estimated rate of $130 per trial day. Thomas F.

Stewart, Gonzaga University assistant professor of chemistry, yesterday told the Knights of Columbus publie forum. J. J. Mangan, the agency's Spokane area manager, said the offer of R. C. Hughes Electric Co.

and Cable Construction Co. was the lowest of seven received. The project involves clearing the 30-mile section between Calispell Lake and lone of the 90-mile stretch for the line running from the Glenn H. Bell substation at Mead north to the Canadian border. BUY, SELL, RENT, TRADE OR LOCATE WANT Spokane WANT PLACE YOUR ACTION PACKED THE EASY THE WANT AD WAY Daily Chronicle TODAY -PHONE Madison ADS appeal move on his part would await the State Supreme Court's orders. Lynch has not been active in the Draper-Lorentzen appeal cases because Draper has taken over as legal spokesman for the pair. In its decision last week, the U.S. Supreme Court held that the rules of the State Supreme Court -under which Judge Evans was acting -discriminate against defendants who do not have the means to prepare appeals. In a dissenting opinion, Justice Byron K.

White said he was at a loss to explain why the majority of the court could declare inadequate the statement of facts prepared by principals on both sides in the Draper-Lorentzen trial, and the fact that briefs were filed with the State Supreme Court and that oral arguments were made by appointed counsel. Arrested After Holdup Draper and Lorentzen were arrested along with two other men after two holdups occurred within minutes at the TraveLodge and Downtowner motels and a total of $2,300 was taken. After a high-speed, shot-punctuated chase along downtown streets, the suspected holdup men's car was knocked out of control by a police prowl car driven by Officer Robert Bailor. The other two men, Robert Jennings and James D. Long, are serving two consecutive 20-year prison sentences each Jennings in Leavenworth Federal Prison after he became a state's witness.
